Terms of Service

These Terms of Service ("Terms") govern your use of Strata, a backcountry trip-planning app operated by Highloop LLC ("we", "us"). By creating an account or using the app, you agree to these Terms. If you do not agree, do not use Strata.

1. Safety disclaimer — read this first

Backcountry travel is inherently dangerous and can result in serious injury or death. Avalanches, falls, rockfall, weather, water crossings, navigation error, and equipment failure can kill even well-prepared, experienced people. Strata is a planning and information tool. It does not make decisions for you, guarantee your safety, or replace training, experience, judgment, and current local knowledge.

You must be at least 18 years old to use Strata. By using the app you represent that you are 18 or older and able to enter into a binding agreement.

You retain ownership of the routes, trips, notes, tracks, and other content you create in Strata. You grant us a limited license to store, process, and display that content as needed to operate the service for you and the companions you choose to share it with. You are responsible for the content you create and share.

Strata is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the service, its data, or its safety analysis will be accurate, complete, current, uninterrupted, or error-free.

8. Limitation of liability

To the maximum extent permitted by law, Highloop LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, death, property damage, or loss arising out of or related to your use of — or inability to use — Strata, its data, or its safety features, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Highloop LLC from any claims, losses, or expenses (including reasonable legal fees) arising out of your use of the service, your content, or your violation of these Terms.

10. Termination

You may stop using Strata and delete your account at any time (see Delete your account). We may suspend or terminate your access if you violate these Terms or to comply with the law. Sections that by their nature should survive termination (including 1, 7, 8, and 9) will survive.

11. Changes to these Terms

We may update these Terms from time to time. We'll post changes at this URL and update the "Last updated" date; material changes will also be notified in-app or by email. Continued use after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in San Francisco, California, and you consent to their jurisdiction.
